Will Supreme Court Consider Incorporation?

According to the Supreme Court blog two key Second Amendment cases will be considered early in the next Term. The key cases are National Rifle Association v. Chicago and McDonald v. Chicago. The key question here is whether or not the Second Amendment is incorporated under the 14th Amendment, and therefore applicable to not only Federal Law, but State and local ordinances as well. If the case is heard and the Second Amendment is incorporated, the decision would in many respects be even bigger than the Heller case that finally (and correctly) ruled that the Second Amendment affirms an individual right. The Supreme Court will consider the cases on September 29th, and we may know as early as September 30th whether or not the cases will actually be heard by the Court.

I predict they'll hear the case, and then rule so narrowly that it avoids addressing the underlying issues in any meaningful way...

That may happen... but I sincerely hope not... we do have the same 5 members who did clairfy that whole "individual right" issue... :D
